My beloved of thirteen years as well as we paid for a residence together in 2002. He pennyless up with me in 2004 as well as we changed out. Both names have been upon a deed, his name is upon a loan. We common losses when we lived in a house. He doesnt wish to share a equity of a home given we changed out. we wish to get my name off a help though do not wish to GIVE him a residence as well as asked for 1/2 of a stream equity.     [Edit] I believe divorce lawyers can not (perhaps, by law) work on contingency fees because if a couple decides not to divorce, the attorneys would get nothing and not encourage the couple to stay married. (Ethically & morally they should do that.) Also (if they worked for contingency fees), they (each) would get a percentage of the settlement. Each lawyer would get a ridiculously high percentage of each ex-marriage partner’s “win”. That is usually 50% up to a specified amount, 33% of the next specified amount, and 25% on the remaining balance of the “win”. That would leave each marriage partner with relatively little. And, one more reason they can not work on contingency is that lawyers would only divorce the rich, because they would not make much divorcing poor people – and poor people would have difficulty getting divorced. [As I said below, I'm not a lawyer - but I believe this is the way it is.]

  2. The situation you describe is not really a real estate question, since the jointly owned property could just as well be a pair of shoes, a bank account, or a car. In this case, I’d contact a divorce attorney – since you’ve been together for 13 years (and in this property together for quite a while). Even though you’re not “married”, you share household assets, and probably will need a court to either grant you a portion of the assets (like a settlement), or issue an injunction that keeps your boyfriend from selling the property until you can come to an agreement.
